Petition for Grant of Review Denied

No. 26-0299/AR. U.S. v. Namon L. Bledsoe. CCA 20250425.

Appeals — Summary Dispositions

No. 26-0077/AF. U.S. v. Vidarr Slayton. CCA 40583. On consideration of Appellant's certificate for review of the decision of the United States Air Force Court of Criminal Appeals, we conclude that in light of United States v. Hunt, __ M.J.__ (C.A.A.F. 2026), the Court of Criminal Appeals did not err in determining that Appellee had made a specific showing of a deficiency of proof to meet the threshold requirement for factual sufficiency review under Article 66(d)(1)(B), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 866(d)(1)(B) (2024). However, we decline to answer certified issue II and remand the record for reconsideration of the factual sufficiency issue as ordered below. Accordingly, it is ordered that certified issue I is answered in the negative; That certified issue II is left unanswered pending remand for reconsideration of the factual sufficiency issue; That certified issue III is now moot; and That the decision of the Court of Criminal Appeals is set aside, and the case is returned to the Judge Advocate General of the Air Force for remand to the Court of Criminal Appeals for further review under Article 66, UCMJ, 10 U.S.C. § 866 (2024). The Court of Criminal Appeals will reconsider the factual sufficiency issue in light of United States v. Moore, 86 M.J. 308 (C.A.A.F. 2026), United States v. Hennessy, 86 M.J. 315 (C.A.A.F. 2026), and United States v. Serjak, 86 M.J. 319 (C.A.A.F. 2026).

No. 26-0300/AF. U.S. v. Jennifer Y. Galvin. CCA 2026-01. On consideration of Appellant's certificate for review of the decision of the United States Air Force Court of Criminal Appeals, and Appellant's motion for summary disposition, we note that after the military judge dismissed Specification 1 of the Charge (Article 92, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 892 (2024) - dereliction of duty as to sexual harassment) based on preemption and other grounds, Appellant appealed that ruling under Article 62, UCMJ, 10 U.S.C. § 862 (2024). Rather than deciding the subject of the appeal, the Court of Criminal Appeals held that the convening authority had no authority to refer Specification 1 to a special court-martial after the Office of Special Trial Counsel had deferred any action to prosecute the alleged sexual harassment as a covered offense. Under Article 67(a)(2), UCMJ, 10 U.S.C. § 867(a)(2), the Judge Advocate General then certified the following issue:

Whether the Air Force Court of Criminal Appeals erred by finding that the convening authority referred Specification 1 of the Charge, a violation of Article 92, UCMJ, to Appellee's court-martial without authority, because the Office of Special Trial Counsel had previously deferred prosecuting the underlying conduct as a covered offense.

We conclude that the Court of Criminal Appeals erred in its decision. United States v. Kruse, __M.J.__ (C.A.A.F. 2026). Accordingly, it is ordered that the certified question is answered in the affirmative; That the motion for summary disposition is granted; That the decision of the Court of Criminal Appeals is set aside; and That the case is returned to the Judge Advocate General of the Air Force for remand to the Court of Criminal Appeals for further review under Article 62, UCMJ, 10 U.S.C. § 862 (2024).
