On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, Appellant's supplement to the petition, Appellant's motion for judicial notice, and the record of trial, it appears that there is inadequate evidence to assess whether then-Chief Judge George Smawley and then-Senior Judge Elizabeth Walker were in "regular active service" at the time the United States Army Court of Criminal Appeals issued its en banc decision reconsidering Appellant's case. Accordingly, it is ordered that Appellee shall file an answer to the supplement within 21 days of the date of this order. Appellee shall also provide a declaration or affidavit responsive to the following questions:

 

1. For former-Chief Judge Smawley:

 

(a) On what date did his assignment to the United States Army Court of Criminal Appeals end?

 

(b) If he retired, on what date did he retire from the United States Army?

 

(c) If he retired, what date did he begin terminal leave?

On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, Appellant's supplement to the petition, Appellant's motion for judicial notice, and the record of trial, it appears there is inadequate evidence to assess whether then-Senior Judge Elizabeth Walker was in "regular active service" at the time the United States Army Court of Criminal Appeals issued its decision in Appellant's case.
