On consideration of the petition for extraordinary relief in the nature of a writ of habeas corpus, and the motion to supplement the record, it is ordered that the motion to supplement the record is hereby granted; and that the petition is denied without prejudice to raising the issue on direct review.

On consideration of the petition for extraordinary relief in the nature of a writ of mandamus and brief in support of, and the motion for a stay pending resolution of the writ of mandamus, it is ordered that the petition is hereby granted; and that the motion is denied as moot.

The Court answers the first granted issue ("[w]hether the Court of Appeals for the Armed Forces has statutory authority to decide whether a conviction is factually sufficient") in the negative.

 

The Court answers the second granted issue ("[w]hether Appellant's conviction for attempted murder of 'Sarah' and attempted conspiracies to rape and kidnap are factually and legally sufficient") in the affirmative to the extent that the issue asks about the legal sufficiency of the evidence and does not answer the issue to the extent that it asks about the factual sufficiency of the evidence.

 

The Court answers the third granted issue ("[w]hether the lower court erroneously interpreted and applied the amended factual sufficiency standard under Article 66(d)(1)(b), UCMJ") by holding that any error was harmless.

 

The decision of the United States Air Force Court of Criminal Appeals is affirmed.

 

No. 25-0012/AF. U.S. v. Makinnon A. Myers. CCA S32749. On consideration of the three issues granted by this Court, __ M.J. __ (C.A.A.F. 2025), and in the light of United States v. Csiti, __ M.J. __ (C.A.A.F. 2025), it is ordered that:
