APPEALS - SUMMARY DISPOSITIONS

 

No. 07-0118/AR.  U.S. v. Floyd T. LATTA, Jr.  CCA 20041175.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, it is ordered that said petition is hereby granted on the following issue specified by the Court:

 

WHETHER THE UNITED STATES ARMY COURT OF CRIMINAL APPEALS ERRED IN AFFIRMING APPELLANT’S CONVICTION UNDER 18 U.S.C. § 2252A(a)(5)(A) OF CHILD PORNOGRAPHY PREVENTION ACT WHERE THAT ACT LACKS EXTRATERRITORIAL JURISDICTION.

 

The decision of the United States Army Court of Criminal Appeals is affirmed, except for the words and figures, “ in violation of Title 18, United States Code Section 2252A(a)(5)(A)” in the Specification of Charge II.  See United States v. Martinelli, 62 M.J. 52 (C.A.A.F. 2005).  The finding of guilty as to those words and figures is set aside and that portion of the Specification is dismissed.   

 

No. 06-0918/MC.  U.S. v. Raymon F. THOMAS, Jr.  CCA 200401149.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, it is noted that that court set aside Specifications 1 and 2 of Charge I (violation of a lawful regulation), Specifications 1 and 2 of Charge II (maltreatment by sexual harassment), Specifications 1 and 2 of Charge IV (adultery), and the Specification of the Additional Charge (fraternization).  The court then stated that the remaining approved findings of guilty were affirmed.  In fact, Charge II and all five of its specifications had been withdrawn by the Government as part of the plea agreement and dismissed.  Moreover, Specification 1 of Charge I and Specification 1 of Charge IV were merged into Specification 2 of Charge III (conduct unbecoming an officer).  Likewise, Specification 2 of Charge I and the Additional Charge and its Specification were merged into Specification 1 of Charge III (conduct unbecoming an officer).  Despite the court’s broad statement that the remaining findings of guilty were affirmed, it then suggested that “[t]he affirmed charges and specifications reflect two separate instances of conduct unbecoming an officer to include a specific quid pro quo offer by the Appellant of time off from work in return for sex from a subordinate female Marine.”  In fact, four specifications of a single charge of conduct unbecoming an officer remained.  Under Article 67(c), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 867(c) (2000), this Court can only act with respect to findings as affirmed by a court of criminal appeals.  Accordingly, because of the ambiguity as to the affirmed findings, it is ordered that said petition is hereby granted.  The decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside, and the record of trial is returned to the Judge Advocate General of the Navy for remand to the United States Navy-Marine Corps Court of Criminal Appeals for clarification as to the affirmed findings.

 

Thereafter, Article 67, UCMJ, shall apply.  This is without prejudice to Appellant’s right to resubmit any assignments of error in a subsequent petition for grant of review to this Court.

 

No. 07-0086/NA.  U.S. v. Theodore THOMPSON.  CCA 200401732.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, we note that the lower court identified the four-prong test for evaluating an alleged post-trial delay, due process violation.  See United States v. Moreno, 63 M.J. 129, 135 (C.A.A.F. 2005)(citing Barker v. Wingo, 407 U.S. 514, 530 (1972)).  In applying the prejudice prong of that test, the Court of Criminal Appeals stated that “[a]bsent a showing of prejudice, there can be no due process violation.”  To the contrary, we have held that “where there is no finding of Barker prejudice, we will find a due process violation only when, in balancing the other three factors, the delay is so egregious that tolerating it would adversely affect the public's perception of the fairness and integrity of the military justice system.”  United States v. Toohey, 63 M.J. 353, 362 (C.A.A.F. 2006).  Consequently, the Court of Criminal Appeals erred as a matter of law in applying the due process test for reviewing post-trial delay.  Appellant is entitled to a new review pursuant to Article 66(c), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 866(c) (2000).  Accordingly, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE LOWER COURT ERRED IN HOLDING THAT, “ABSENT A SHOWING OF PREJUDICE, THERE CAN BE NO DUE PROCESS VIOLATION,” FOR UNREASONABLE POST-TRIAL DELAY IN FORWARDING A RECORD OF TRIAL FOR APPELLATE REVIEW.

 

                The decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside.  The record of trial is returned to the Judge Advocate General of the Navy for remand to the Court of Criminal Appeals for consideration in light of Toohey.  Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), will apply.

 

No. 06-0926/AR. U.S. v. Emily N. HAMILTON. CCA 20050738.  On further consideration of the granted issue, 64 M.J. 391 (C.A.A.F. 2007), and the briefs of the parties, we conclude that the military judge erred when he found Appellant guilty of Specification 5 of Charge III by distributing valium and excepting the words “on divers occasions” and substituting the words “on one occasion” without specifying which occasion was the basis for the guilty finding.  United States v. Scheurer, 62 M.J. 100 (C.A.A.F. 2005).  Accordingly, it is ordered that the decision of the United States Army Court of Criminal Appeals is set aside as to the guilty finding of Specification 5 of Charge III.  Specification 5 of Charge III is dismissed.  The decision of that court as to the remaining charges is affirmed.  The record of trial is returned to the Judge Advocate General of the Army for remand to the Army Court of Criminal Appeals.  That court may reassess the sentence based on the affirmed guilty findings or order a rehearing on the sentence.

REYOSO.  CCA 200401465.  On consideration of Appellee’s motion to dismiss Appellant’s petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, we note that Appellant filed his petition on January 17, 2007.  On that same day, we issued a Docketing Notice directing Appellant to file a supplement to his petition by February 16, 2007.  Both the petition and Docketing Notice were served on Appellee.  Appellant filed his supplement, as required, on February 16 and served it on Appellee.  On February 26, 2007, Appellee entered a general opposition to Appellant’s request for a grant of review, relying on the decision of the Navy-Marine Corps Court of Criminal Appeals.  Appellee subsequently moved to dismiss the petition as untimely on March 29, 2007, more than two months after Appellee received notice of the petition and more than one month after Appellant filed his supplement.  Under these circumstances, we decline to grant the motion to dismiss the petition.  Accordingly, it is ordered that Appellee’s motion to dismiss the petition is denied.

* This Court notes that the convening authority approved, for a period of six months beginning July 9, 2004, Appellant’s request for a waiver of automatic forfeitures pursuant to Article 58b, Uniform Code of Military Justice, 10 U.S.C. § 858b (2000), but the convening authority’s action, dated October 24, 2004, does not include the approved waiver of forfeitures.
