APPEALS - SUMMARY DISPOSITIONS

 

No. 04-0612/CG.  U.S. v. Shams I. ABDUL- RAHMAN.  CCA 1192.  On

consideration of the petition for grant of review of the decision of the United States Coast Guard Court of Criminal Appeals, we conclude that Appellant’s plea of guilty to Specification 1 of Charge V, housebreaking, is provident only as to the lesser included offense of unlawful entry in violation of Article 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 934 (2000).  Accordingly, it is ordered that the petition is granted on the following issue:

 

WHETHER APPELLANT'S PLEA TO HOUSEBREAKING IS IMPROVIDENT WHERE APPELLANT ADMITTED TO UNLAWFULLY ENTERING THE FEMALE BERTHING AREA WITH THE INTENT TO COMMIT A VIOLATION OF A LAWFUL GENERAL REGULATION, A PURELY MILITARY OFFENSE.

 

The decision of the United States Coast Guard Court of Criminal Appeals as to Specification 1 of Charge V is reversed.  Only so much of the decision of the court below as to Specification 1, Charge V, as affirms a finding of guilty of unlawful entry, under Article 134, UCMJ, the remaining findings of guilty, and the sentence are affirmed.  [See also ORDERS GRANTING PETITION FOR REVIEW this date.]

Misc. No. 05-8007/NA.  Roberto RODRIGUEZ-RIVERA, Petitioner, v. United States and The Judge Advocate General of the Navy, Respondents.  CCA 9900859.  This Court has considered the petition for extraordinary relief in the nature of a writ of mandamus, or alternatively a writ of habeas corpus, the Respondents’ answers to orders to show cause, and Petitioner’s replies to the Respondents’ answers.  The Court has further considered the following:  Petitioner’s motion to attach documents; Respondent United States’ motion to dismiss; Petitioner’s opposition to Respondent United States’ motion to dismiss; Respondent United States’ reply to Petitioner’s opposition to motion to dismiss; Respondent Judge Advocate General of the Navy’s motion to vacate show cause order, or alternatively, extend date for filing of response; and Respondent United States’ motion to attach documents.

 

Petitioner requested that “this Court uphold his right to a timely review and issue a writ of mandamus and order the lower court to decide his case within thirty days or, in the alternative, issue a writ of habeas corpus to release [Petitioner] from confinement pending resolution of his appeal.”  We note that on January 10, 2005, the Navy-Marine Corps Court of Criminal Appeals issued its decision in Petitioner’s case, affirming the findings and sentence.  In addition, on January 18, 2005, that court denied Petitioner’s motion to reconsider en banc and motion to reconsider.

 

We further note that Respondent Judge Advocate General of the Navy has filed an answer to show cause order of December 22, 2004.

 

In light of the foregoing, it is ordered that Petitioner’s and Respondent United States’ motions to attach documents are hereby granted;

 

That Respondent Judge Advocate General of the Navy’s motion to vacate show cause order, or alternatively, extend date for filing of response is hereby denied as moot, as the Judge Advocate General of the Navy filed an answer to the show cause order, which is attached as an appendix to this order; and

 

 That Petitioner’s petition for extraordinary relief in the nature of a writ of mandamus, or alternatively a writ of habeas corpus is hereby dismissed without prejudice to Petitioner’s right to raise the issues asserted therein during the ordinary course of appeal.

WHETHER THE ADDITIONAL CHARGE FAILS TO STATE AN OFFENSE, INSOMUCH AS IT ALLEGES THAT APPELLANT CONSPIRED WITH AN UNDERCOVER AGENT.

 

     The Specification of the Additional Charge is amended to read as follows:

 

In that SSG Stephen C. Adams, U.S. Army, did, at

or near Fort Campbell, Kentucky, between on or about

1 November 1999 and 17 November 2000, conspire with

an undercover government agent posing as “Johnny” and

Carolyn Burdette to commit an offense under the

Uniform Code of Military Justice, to wit: premeditated

murder, and in order to effect the object of the

conspiracy the said SSG Adams gave detailed sketches

and a $500 (five hundred dollar) retainer to the said

undercover government agent posing as “Johnny” for the

purpose of killing Randy Lee Burdette.

 

The decision of the United States Army Court of Criminal Appeals is affirmed as to the Charge and Specifications 1 and 2 thereunder, the Additional Charge and the Specification thereunder as amended, and the sentence.  [See also ORDERS GRANTING PETITION FOR REVIEW this date.]
