APPEALS - SUMMARY DISPOSITIONS

 

No. 05-0233/NA.  U.S. v. George G. TAYLOR Jr.  CCA 200200435.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, said petition is granted on the following issue:

 

WHETHER APPELLANT WAS DENIED HIS SIXTH AMENDMENT RIGHT TO EFFECTIVE ASSISTANCE OF COUNSEL DURING SENTENCING AND THE CLEMENCY PROCESS.

 

     The decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside.  The record of trial is returned to the Judge Advocate General of the Navy for remand to that court to obtain an affidavit from the trial defense counsel responding to Appellant’s allegation of ineffective assistance of counsel.  In the course of conducting its new review under Article 66(c), Uniform Code of Military Justice, 10 U.S.C. § 866(c) (2000), the Court of Criminal Appeals shall review the trial defense counsel’s affidavit and any other relevant matters.  See United States v. Ginn, 47 M.J. 236 (C.A.A.F. 1997).  Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), shall apply.  [See also ORDERS GRANTING PETITION FOR REVIEW this date.]
