APPEALS - SUMMARY DISPOSITIONS

No. 03-0207/AF. U.S. v. William BLAKE Jr. CCA 34482. On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, the petition is granted on the following issue raised by appellate defense counsel:

WHETHER APPELLANT'S TRIAL DEFENSE COUNSEL WAS INEFFECTIVE BECAUSE OF (A) HIS FAILURE TO INTRODUCE SPECIFIC EVIDENCE REGARDING THE RETIREMENT BENEFITS THAT APPELLANT WOULD FORFEIT AS A RESULT OF A PUNITIVE DISCHARGE; (B) HIS INSISTENCE ON INTRODUCING EVIDENCE THAT ULTIMATELY LED TO THE ADMISSION OF EVIDENCE OF THE CHARGE THAT HAD BEEN DISMISSED BY THE CONVENING AUTHORITY; (C) HIS FAILURE TO EFFECTIVELY REVIEW APPELLANT'S UNSWORN STATEMENT; AND (D) HIS FAILURE TO INTRODUCE SPECIFIC INFORMATION TO THE CONVENING AUTHORITY REGARDING THE IMPACT A PUNITIVE DISCHARGE WOULD HAVE ON APPELLANT'S RETIREMENT BENEFITS. The decision of the United States Air Force Court of Criminal Appeals is set aside. The record of trial is returned to the Judge Advocate General of the Air Force for remand to that court to obtain an affidavit from trial defense counsel which responds to appellant’s allegation of ineffective assistance of counsel. Under Article 66(c), Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 866(c) (2000), the Court of Criminal Appeals shall review its original decision on the granted issue in light of the affidavit and any other relevant matters. See United States v. Ginn, 47 M.J. 236 (C.A.A.F. 1997). Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), shall apply. [See also ORDERS GRANTING PETITION FOR REVIEW.]

MISCELLANEOUS DOCKET - FILINGS

Writ-appeal petition for review of the United States Air Force Court of Criminal Appeals decision on application for extraordinary relief was filed under Rule 27(b) on March 6, 2003 and placed on the docket this date.

INTERLOCUTORY ORDERS

No. 00-0559/AF. U.S. v. David E. GILLEY. CCA 32877. On consideration of the petition for grant of review in the above-entitled case, this Court notes that there are no pleadings in the record of trial indicating that Appellant was represented by counsel before the court below. This Court mandated that Appellant's case would be returned to the Air Force Court of Criminal Appeals for further review upon completion of the new convening authority's action. United States v. Gilley, 56 M.J. 113, 125 (C.A.A.F. 2001). The new action was accomplished on June 26, 2002. Thereafter, Appellant's case was returned to the Air Force Court of Criminal Appeals on July 25, 2002, and the court's opinion was rendered on August 3, 2002. The record of trial does not disclose that Appellant was afforded the right to file an assignment of error to the court below prior to its further review. Rule 15(b) of the Courts of Criminal Appeals Rules of Practice and Procedure provides that an accused shall have 60 days to file an assignment of error. The record before this Court does not reflect that a brief was filed, that the case was submitted on the merits, or that the time for filing of the briefs had expired. It appears that the decision of the Air Force Court of Criminal Appeals may have been premature. Accordingly, it is ordered that counsel for the United States show cause on or before June 2, 2003, why the decision of the Air Force Court of Criminal Appeals should not be set aside and the case remanded to that court for further review in accordance with Article 66, Uniform Code of Military Justice, 10 U.S.C. § 866 (2000).
