No. 01-0786/AF. U.S. v. Manuel MARMOLEJO. CCA 33950. On consideration of the petition for grant of review and the responsive pleadings thereto, a question has been raised whether trial defense counsel submitted a request for waiver of forfeitures on appellant’s behalf. Accordingly, it is ordered that the record of trial is returned to the Judge Advocate General of the Air Force for remand to the United States Air Force Court of Criminal Appeals for a determination consistent with the principles of United States v. Ginn, 47 MJ 236 (1997), as to whether trial defense counsel submitted a request for waiver of forfeitures on appellant’s behalf. If the Court of Criminal Appeals finds that trial defense counsel did not submit the request, that court shall review the record in accordance with Article 66(c), Uniform Code of Military Justice, 10 USC § 866(c), and resolve the issue whether counsel was deficient for not doing so, and if so, whether appellant was prejudiced. Thereafter, Article 67, UCMJ, 10 USC § 867, shall apply.

    CRAWFORD, Chief Judge (dissenting):

There is no Codal or Manual requirement that the Staff Judge Advocate’s recommendation include a comment on a request for waiver of automatic forfeitures. United States v. Brown, 54 MJ 289 (2000). Foremost, appellant did not raise the ineffectiveness of counsel issue before the Air Force. Therefore, the issue is waived. United States v. Johnson, 42 MJ 443, 447 (1995) (Crawford, J., concurring in the result).
    SULLIVAN, Senior Judge (dissenting):
Articles 58b and 59, UCMJ, 10 USC §§ 858b and 859, should be read together. In my view, the failure of trial defense counsel to submit a request for waiver of automatic forfeitures was not prejudicial simply because appellant had dependents and "[i]t is common knowledge that waivers are routinely granted for the benefit of a dependent child[.]" (Appellant’s Supplement at 6).

I think appellant has to show more; namely, that there was a reasonable probability that such a request would be granted in his case. He has not done so and, accordingly, no fact hearing is required under United States v. Ginn, 47 MJ 236, 248 (1997) (First and Second Principles).

On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, we note that the decision of the court below is not free from ambiguity with respect to the standard applied during consideration of factual sufficiency under Article 66, UCMJ, 10 USC § 866. SeeUnited States v. Sills, 56 MJ 239, 241 (2002). It should be clarified on remand. Accordingly, said petition is granted on the following issue, without prejudice to appellant’s right to again raise Issue II in the normal course of appellate review:

WHETHER THE AIR FORCE COURT OF CRIMINAL APPEALS APPLIED THE PROPER STANDARD WHEN EVALUATING THE FACTUAL SUFFICIENCY OF THE EVIDENCE. No briefs will be filed under Rule 25; and, the decision of the United States Air Force Court of Criminal Appeals is set aside. The record of trial is returned to the Judge Advocate General of the Air Force for remand to that court for further review consistent with United States v.
