    SULLIVAN, Judge (dissenting):

    If a group of travelers goes down the wrong path, that is a mistake. If that group later sees a clear sign that they have gone the wrong way, but they still continue down the same path, then they are making not one but two mistakes.

The majority should realize by the instant petition of the Government that its prior decision in this case has not clarified the law but has confused it. As I stated in my prior dissent:

I fail to understand why the majority is departing from United States v. Roland, 50 MJ 66 (1999), which was decided only a year ago. United States v. Kirkland, 53 MJ 22, 25 (2000) (Sullivan, J., dissenting).

Apparently the Government sees the same disturbance to the law in this area:

This Court’s decision [the majority opinion] to reverse the Air Force Court of Criminal Appeals’ decision in the aforementioned case [Kirkland] and affirm the lower court’s decision in United States v. Roland, 50 MJ 66 (1999), without explicitly providing the factors this Court relied on in distinguishing the two cases, fails to provide sufficient guidance to trial practitioners. Due to the factual similarities as expressed in this Court’s Kirkland and Roland opinion, the United States, and others in the field, are left to speculate as to the specific indicia this Court looks for in determining improper court member selection. [*] (Footnotes omitted; emphasis added.)

Today, the majority makes its second mistake in this case. I respectfully dissent. I would grant the Government’s petition and clarify the law.
