Disposition

26-0150/AR. U.S. v. Konner L. Ruhrup. CCA 20230282. On consideration of
the petition for grant of review of the decision of the United States Army
Court of Criminal Appeals, we note that the Court of Criminal Appeals contended
that the Statement of Trial Results incorrectly listed the total confinement as
"11 Years and 10 Months." The Court of Criminal Appeals calculated the total
confinement as "10 years and 11 months," corrected the perceived error, and
affirmed the sentence. But the total confinement, based on consecutive
sentences for nine separate specifications, is 11 years and 10 months of
confinement. Accordingly, it is ordered that said petition is granted on the
following issue:
Whether the Court of Criminal Appeals
erroneously corrected Appellant's total confinement.
The
decision of the United States Army Court of Criminal Appeals is affirmed as to
findings and set aside as to sentence. The record is returned to The Judge
Advocate General of the Army for remand to the Court of Criminal Appeals for a
new review of the sentence, consistent with this order, under Article 66(d)(1),
Uniform Code of Miliary Justice, 10 U.S.C. § 866 (d)(1) (2018).

Whether
the lower Court's ruling on the exclusive authority granted to the Special
Trial Counsel under Article 24a, UCMJ, runs counter to the statute's plain
meaning, the will of Congress, and creates an absurd result.
