WATKINS. CCA 20110040. On consideration of the petition for grant of
review of the decision of the United States Army Court of Criminal Appeals, we
note that the convening authority's 29 November 2012 action mistakenly
reports that the original action "was set aside by the United States Court of
Appeals for the Armed Forces on 30 May 2012, pursuant to Article 66,
Uniform Code of Military Justice." We
never issued this order. Instead, the
United States Army Court of Criminal Appeals set aside the original
action. Because of this clerical error
in the action, the promulgating order contains the same error when reciting the
action. Accordingly, it
is ordered that said petition is hereby granted, the
action and promulgating order be corrected to reflect that the United States
Army Court of Criminal Appeals set aside the original action, and the decision
of the United States Army Court of Criminal Appeals is affirmed. [See also ORDERS GRANTING PETITION FOR REVIEW
