of the petition for grant of review of the decision of the United States Army
Court of Criminal Appeals, Appellant's supplement to the petition, and the
record of trial, we note that the record does not contain that decision, the
briefs filed with the lower court, the court's order of June 6, 2012, or the
documents referred to in that order.
However, the record does contain a set of written instructions on the
findings from a court-martial entirely unrelated to the present case. The two errors assigned before this
Court are based upon the presence of those instructions in the record and the
absence in the record of the actual written instructions the military judge
provided to the members in this case.
Accordingly, it is ordered that Appellee shall
file an answer to the supplement within 20 days of the date of this order, along
with the missing documents.
Appellant may file a reply within 5 days of the
answer.
