SPECIAL DOCKET MATTERS

 

No. 09-01.  In the Matter of James F. Clark, III.  Pursuant to Rule 15(b), Rules of Practice and Procedure of the United States Court of Appeals for the Armed Forces, the above-named attorney was suspended from the practice of law before the Court on October 1, 2008, and ordered to show cause why he should not be disbarred.  This suspension was a reciprocal action following his suspension by the Supreme Court of Alaska due to the attorney’s guilty plea in the U.S. District Court for the District of Alaska to a violation of Title 18, U.S. Code § 371.  Sentencing was continued to October 15, 2010.  In reply to the show cause order, he requested a postponement of further proceedings pending further order of the Court, which was granted with the condition that he notify the Court of any further action by the Alaska State bar or the Supreme Court of Alaska. 

On October 13, 2010, the U.S. District Court for the District of Alaska granted Mr. Clark’s motion to dismiss the information filed against him.  The Supreme Court of Alaska reinstated him to the practice of law on November 5, 2010.  He now petitions for reinstatement before this Court.

In view of the above, the Petition for Reinstatement to Practice Law before the Court from James F. Clark, III, is granted and he is hereby reinstated to the Bar of this Court effective the date of this Order.

Bergrin is hereby disbarred from the practice of law before this Court effective the date of this Order.

APPEALS SUMMARY DISPOSITIONS

 

No. 11-0052/MC.  U.S. v. Daniel J. FIELDS.  CCA 200900589.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, we note that this general court-martial sentenced Appellant, inter alia, to be reduced to the pay grade E-1 and “to forfeit $3,226.20 pay per month for three months.”  The convening authority approved the sentence.  This was error for two reasons.  First, the amount was not based on the pay grade to which Appellant was reduced, and second, the amount was not stated in a whole dollar amount.  See Rule for Courts-Martial (R.C.M.) 1003(b)(2).  The Navy-Marine Corps Court of Criminal Appeals failed to correct this error when it incorrectly stated the adjudged forfeitures as “total forfeitures for three months” and then affirmed the sentence “as approved by the convening authority.”  Accordingly it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE AFFIRMED FORFEITURE OF $3,226.20 PAY PER MONTH FOR THREE MONTHS WAS ILLEGAL UNDER R.C.M. 1003(b)(2).

 

The decision of the Navy-Marine Corps Court of Criminal Appeals is affirmed as to findings and to only so much of the sentence as provides for reduction to pay grade  E-1, forfeiture of $1,399.00 pay per month for three months, confinement for three months, and a dishonorable discharge.  [See also ORDERS GRANTING PETITION FOR REVIEW this date.]

ARTICLE 120 OF THE UCMJ PROVIDES AN AFFIRMATIVE DEFENSE IF THE ACCUSED CAN SHOW, BY A PREPONDERANCE OF THE EVIDENCE, THAT THE VICTIM USED WORDS OR OVERT ACTS INDICATING AGREEMENT TO THE SEXUAL CONDUCT AT ISSUE AND WAS COMPETENT.  THIS STATUTORY SCHEME VIOLATES DUE PROCESS OF LAW BY PLACING A BURDEN ON THE ACCUSED TO DISPROVE AN ELEMENT OF THE GOVERNMENT'S CASE.

ROSE.  CCA 36508.  Upon further consideration of the certified issue (69 M.J. 198), we note that because of an ambiguity in this Court’s order of October 28, 2009 (68 M.J. 236), where we set aside the decision of the United States Air Force Court of Criminal Appeals, but ordered a new review of only Issue II, the Court of Criminal Appeals, in its subsequent decision of June 11, 2010, acted on the findings with respect to Specifications 1, 2, and 3 of Charge V, but not on the remaining findings and the sentence.  This has resulted in having a case before us for review that does not have a complete decision on all findings and a sentence by the Court of Criminal Appeals as required by Article 67(c), Uniform Code of Military Justice, 10 U.S.C. § 867(c) (2006).  Accordingly, it is ordered that the case is returned to the Judge Advocate General of the Air Force for remand to the lower court to complete its review under Article 66(c), UCMJ, as to the remaining findings and the sentence.  The hearing notice issued on September 28, 2010, is hereby rescinded.

 

No. 11-0067/AR.  U.S. v. Timothy B. FILLINGER.  CCA 20100155.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, it is noted that in his action, the convening authority failed to approve or disapprove the sentence as required by Rule for Courts-Martial (R.C.M.) 1107(d)(1).  Rather, he merely ordered parts of the sentence, not to include the bad-conduct discharge, executed.  Such an action is incomplete and ambiguous.  Accordingly, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE CONVENING AUTHORITY'S ACTION THAT FAILED TO APPROVE OR DISAPPROVE THE SENTENCE BUT ORDERED PARTS OF THE SENTENCE, NOT TO INCLUDE THE BAD-CONDUCT DISCHARGE, EXECUTED, IS INCOMPLETE AND AMBIGUOUS.
