No. 07-0051/AR.  U.S. v. Eric R. KRULISKY.  CCA 20051100.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, we conclude that Appellant’s guilty plea to wrongfully possessing a hose and burner and a specific number of syringes in the Specification of Charge IV was improvident when Appellant asserted during the providence inquiry that those items were not possessed for the purpose of ingesting illegal drugs.  See United States v. Prater, 32 M.J. 433 (C.M.A. 1991).   Accordingly, it is ordered that said petition is granted on the following issue:

 

WHETHER APPELLANT’S GUILTY PLEA TO WRONGFULLY POSSESSING A HOSE AND BURNER AND A SPECIFIC NUMBER OF SYRINGES IN THE SPECIFICATION OF CHARGE IV WAS IMPROVIDENT WHEN APPELLANT ASSERTED DURING THE PROVIDENCE INQUIRY THAT THOSE ITEMS WERE NOT USED TO INGEST ILLEGAL DRUGS.  

 

The decision of the United States Army Court of Criminal Appeals is affirmed, except for the words and figures, “hose and burner” and “approximately 200” in the Specification of Charge IV.  The finding of guilty as to those words and figures is set aside and that portion of the Specification is dismissed.[See also ORDERS GRANTING PETITION FOR REVIEW this date.]

 

No. 07-0115/AR.  U.S. v. Jason K. GRINER.  CCA 20040313.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, it is ordered that said petition is granted. FREDENBURG.  CCA 35880.  On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, it is ordered that said petition is hereby granted, and the decision of the United States Air Force Court of Criminal Appeals is affirmed.[See also ORDERS GRANTING PETITION FOR REVIEW this date.]

 

No. 06-0742/NA.  U.S. v. Kermit CAVES.  CCA 200100171.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, and in light of United States v. Moreno, 63 M.J. 129 (C.A.A.F. 2006), and United States v. Allison, 63 M.J. 365 (C.A.A.F. 2006), assuming that Appellant was denied his due process right to speedy post-trial review and appeal, we conclude that any error in that regard was harmless beyond a reasonable doubt.  Accordingly, said petition is hereby granted on Issue I as raised by appellate defense counsel, and the decision of the United States Navy-Marine Corps Court of Criminal Appeals is affirmed.[See also ORDERS GRANTING PETITION FOR REVIEW this date.]

 

No. 07-0020/AR.  U.S. v. Lucille S. DIXON.  CCA 20050954. On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER APPELLANT RECEIVED INEFFECTIVE ASSISTANCE OF COUNSEL WHEN HIS TRIAL DEFENSE COUNSEL FAILED TO INTRODUCE EVIDENCE OF HER MEDALS AND DECORATIONS IN THE PRESENTENCING HEARING. 

 

The decision of the United States Army Court of Criminal Appeals is affirmed as to findings but set aside as to sentence.  The record of trial is returned to the Judge Advocate General of the Army for remand to that court to obtain an affidavit from the trial defense counsel relating to the granted issue.  In the course of conducting its new review under Article 66(c), Uniform Code of Military Justice, 10 U.S.C. § 866(c) (2000), the Court of Criminal Appeals shall review the trial defense counsel’s affidavit and any other relevant matters.  See United States v. Ginn, 47 M.J. 236 (C.A.A.F. 1997).  Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), shall apply. [See also ORDERS GRANTING PETITION FOR REVIEW this date.]

No. 06-0729/AR.  U.S. v. Harold R. SPICER.  CCA 20030359.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE ARMY COURT OF CRIMINAL APPEALS ERRED IN AFFIRMING THE FINDINGS BECAUSE APPELLANT STATED THAT HE KEPT BOTH ECSTASY AND COCAINE FOR PERSONAL USE, CREATING AN INCONSISTENCY WITH HIS GUILTY PLEA TO POSSESSION WITH THE INTENT TO DISTRIBUTE (SPECIFICATION 4), WHICH THE MILITARY JUDGE FAILED TO CLARIFY.

 

The decision of the United States Army Court of Criminal Appeals is affirmed except for that portion of Specification 4 of Charge II that includes the words “with the intent to distribute the said controlled substances.”  The finding of guilty as to those words is set aside and that portion of Specification 4 is dismissed. [See also ORDERS GRANTING PETITION FOR REVIEW this date.] 

 

No. 06-0949/AR.  U.S. v. Felecia A. JOHNSON.  CCA 20040993.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, the Court notes that the military judge adjudged a sentence including the following punishment, "if you fail to tender a cashier's check in the amount of $12,960.00 in restitution to the United States Treasury within 30 days from the date of trial, that you be further confined for an additional one year."  The convening authority approved the sentence in accordance with the pretrial agreement, and the lower court summarily affirmed the approved findings and sentence.

 

Inasmuch as the President has not authorized either restitution or restitution with contingent confinement as punishments under the Uniform Code of Military Justice (UCMJ), we conclude that this portion of the sentence was unlawful.  Article 18, UCMJ, 10 U.S.C. § 818 (2000); Rule for Courts-Martial 1003.  We also conclude that the record does not show whether Appellant was prejudiced by this sentencing error.

 

Accordingly, it is ordered that said petition is granted on the following specified issue:

 

WHETHER THE MILITARY JUDGE COMMITTED PREJUDICIAL ERROR BY ADJUDGING A SENTENCE INCLUDING RESTITUTION AND ADDITIONAL CONFINEMENT IF THE RESTITUTION WAS NOT PAID.

 

The decision of the United States Army Court of Criminal Appeals is affirmed as to the findings but set aside as to the sentence.  The record of trial is returned to the Judge Advocate General of the Army for remand to the Court of Criminal Appeals for further consideration of the sentence.  If the Court of Criminal Appeals determines that Appellant was prejudiced by the sentencing error, it may either reassess the sentence or direct a rehearing.  Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), will apply. [See also ORDERS GRANTING PETITION FOR REVIEW this date.]

Allison, 63 M.J. 365 (C.A.A.F. 2006), assuming that Appellant was denied his due process right to speedy post-trial review and appeal, we conclude that any error in that regard was harmless beyond a reasonable doubt.  Accordingly, said petition is hereby granted on Issue IV as raised by appellate defense counsel, and the decision of the United States Navy-Marine Corps Court of Criminal Appeals is affirmed.* [See also ORDERS GRANTING PETITION FOR REVIEW this date.]

 

* It is directed that the promulgating order be corrected to reflect that Appellant pleaded guilty to use of LSD in Specification 7 of Charge II.
