Grostefon, 12 M.J. 431 (C.M.A. 1982), and motion to order a sanity board, it appears that a substantial question has been raised concerning the mental capacity of Appellant to participate in the appellate proceedings.  It further appears that there may be an issue relating to the mental responsibility of Appellant at the time of the alleged offenses that was neither raised nor litigated below.  We therefore deem it appropriate to remand the record to the United States Army Court of Criminal Appeals for consideration of the matters now sought to be raised by Appellant.  Accordingly, it is ordered that Appellant’s motion to attach additional matters be granted; and that the record be remanded to the United States Army Court of Criminal Appeals for consideration of such issues as may be raised by Appellant concerning his mental condition and for such action thereon as may be deemed appropriate by that court.  This order is without prejudice to Appellant’s future rights under Article 67, Uniform Code of Military Justice, 10 U.S.C. § 867.

APPEALS - SUMMARY DISPOSITIONS

 

No. 06-0273/AF.  U.S. v. Bradley J. GIVENS.  CCA 35789.  On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, we conclude that specifications 1 and 2 of Charge III are factually the same and multiplicious for findings with specifications 2 and 3 of Charge II, respectively.  However, because the military judge considered the offenses multiplicious for sentencing, we are satisfied that Appellant was not prejudiced as to sentence.  Accordingly, it is ordered that said petition is hereby granted on the following issue:

WHETHER APPELLANT’S CONVICTIONS FOR CHARGE II, SPECIFICATIONS 2 AND 3 (VIOLATING A LAWFUL GENERAL REGULATION UNDER ARTICLE 92, UCMJ) ARE MULTIPLICIOUS WITH HIS CONVICTIONS FOR CHARGE III, SPECIFICATIONS 1 AND 2 (FRATERNIZATION UNDER ARTICLE 134, UCMJ).

 

     The decision of the United States Air Force Court of Criminal Appeals is reversed as to specifications 1 and 2 of Charge III, but is affirmed in all other respects.  The findings of guilty as to specifications 1 and 2 of Charge III are set aside and those specifications are dismissed.
