No. 03-0022/AF. U.S. v. Julian LATORRE. CCA 34670. On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, said petition is granted as to Assigned Issue II, as follows:

II. WHETHER THE AIR FORCE COURT OF CRIMINAL APPEALS ERRED BY REFUSING TO ACCEPT APPELLANT'S TIMELY-FILED REQUEST FOR RECONSIDERATION WHICH ALLEGED IN PART THAT HIS PRIOR APPELLATE DEFENSE COUNSEL HAD BEEN INEFFECTIVE BY FAILING TO GIVE HIM THE OPPORTUNITY TO SUBMIT ISSUES UNDER UNITED STATES v. GROSTEFON, 12 M.J. 431 (C.M.A. 1982). That the decision of the United States Air Force Court of Criminal Appeals is set aside. The record of trial is returned to the Judge Advocate General of the Air Force for remand to that court for reconsideration. The Court of Criminal Appeals will obtain affidavits from initially assigned appellate defense counsel relating to the granted issue. Thereafter, if necessary, see United States v. Lewis, 42 M.J. 1, 6 (C.A.A.F. 1995), the court shall order further inquiry pursuant to United States v. DuBay, 17 C.M.A. 147 (1967). If the court concludes that, during initial review by that court, Appellant was denied effective assistance of appellate defense counsel in presenting matters for the court's consideration under United States v.
