On further consideration of the granted issue and the pleadings and arguments of both parties, we note that in response to our September 28, 2001, order directing the Government either to (1) "file with the Court . . . a brief addressing the matters raised in Parts IV and V" of that order, or (2) "submit the requested NCIC records at issue," 56 MJ 156, 160 and n.2, the Government submitted the NCIC records to this Court and served a copy on appellate defense counsel.

We have thoroughly examined these records and determined they do not contain any material information concerning the two Government witnesses to whom they relate. See United States v. Bagley, 473 U.S. 667, 682 (1985). Therefore, we conclude there is no "reasonable probability that, had the [NCIC records] been disclosed to the defense, the result of the proceeding would have been different." Id. Accordingly, it is ordered that the decision of the United States Army Court of Criminal Appeals is affirmed.

Misc. No. 02-8012/AF. United States, respondent, v. Michael C. BROWN, petitioner. CCA 32906. On consideration of the above-entitled case, we note that on original review, this Court affirmed the decision of the Court of Criminal Appeals in part and reversed that decision in part as to findings, set aside the sentence, returned the record to the Judge Advocate General, and provided that a "rehearing as to sentence may be ordered." 55 MJ 375, 388 (2001). The Government, prior to transmitting the case to the Court of Criminal Appeals, did not request that the Judge Advocate General be provided with the option of sending this case to the Court of Criminal Appeals, nor did the Government seek reconsideration, reconsideration out of time, or further review of our decision on the grounds that a rehearing on sentence would be impractical.

The Air Force Legal Services Agency transmitted the record of trial to the Air Force Court of Criminal Appeals on January 3, 2002, for further appellate action, rather than transmitting it to a convening authority empowered to order a rehearing pursuant to the decretal paragraph of our decision. Petitioner has asked this Court for extraordinary relief to ensure that further action is taken in accordance with our original decision. Accordingly, it is ordered that the petition for extraordinary relief is granted; and that the Court of Criminal Appeals is directed to return this case, without further action, to the Judge Advocate General for action consistent with this Court’s decision upon original review. Taylor, 353 U.S. 569 (1957)).

Misc. No. 02-8013/AF. United States, respondent, v. Janice M. WASHINGTON, petitioner. CCA S29570.
