APPEALS—SUMMARY DISPOSITIONS

No. 01-0751/MC. U.S. v. Michael D. SHEPPERD. CCA 01-0800. On further consideration of the granted issue and specified issue (56 MJ 246 (2001)), in light of United States v. Tardif, No. 01-0520, ____ MJ ____ (2002), we conclude that a remand is necessary so that the court below can exercise its broad authority under Article 66(c), Uniform Code of Military Justice (UCMJ), 10 USC § 866(c), to determine whether relief is warranted and, if so, what relief should be granted. In light of our disposition of the granted issue, we do not reach the specified issue. Accordingly, it is ordered that the decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside. The record of trial is returned to the Judge Advocate General of the Navy for remand to the Court of Criminal Appeals for further consideration in light of Tardif, supra. Thereafter, Article 67, UCMJ, 10 USC § 867, will apply.

CRAWFORD, C.J. (dissenting): I dissent for the reasons set forth in my separate dissenting opinion in United States v. Tardif, No. 01-0520, ____ MJ ____ (2002).

SULLIVAN, S.J. (dissenting): I disagree with this remand for the same reasons I dissented in United States v. Tardif, No. 01-0520, ____ MJ ____ (2002).

APPEALS—SUMMARY DISPOSITIONS

No. 01-0452/AF. U.S. v. Randy J. THOMPSON. CCA 33332. On further consideration of the above-entitled case, we conclude that the decision of the Supreme Court of the United States in Ashcroft v. Free Speech Coalition, ___ U.S. ___, 122 S.Ct. 1389(2002), directly impacts the instructions to the members in appellant’s case. Appellant stands convicted of violations under 18 USC §§ 2252 and 2252A. Sections 2256(8)(B) and 2256(8)(D) of Title 18 USC contain definitions relevant to §§ 2252 and 2252A. In Ashcroft, the Court held 18 USC §§ 2256(8)(B) and 2256(8)(D) unconstitutional. The instructions in appellant’s case rely directly on the definitions contained in 2256(8)(B) and 2256(8)(D). Thus, we conclude the members were improperly instructed as a matter of law. Accordingly, it is ordered that the decision of the United States Air Force Court of Criminal Appeals reversed. The findings of guilty and the sentence are set aside, and a rehearing is authorized. The record of trial is returned to the Judge Advocate General of the Air Force.

CRAWFORD, Chief Judge (dissenting):

The defense made no motion to dismiss based on a challenge to the constitutionality of the statute; no objection to the instructions; and no assertion that the exhibits were not pictures of actual children. Furthermore, the testimony and the evidence establish that the exhibits are pictures of actual children. Thus, Ashcroft v. Free Speech Coalition, ___ U.S. ___, 122 S.Ct. 1389 (2002), had no impact on the instructions. For these reasons, I dissent.

SULLIVAN, Senior Judge (dissenting):

Erroneous instructions concerning an element of a criminal offense do not per se require reversal of a criminal conviction. See Rose v. Clark, 478 U.S. 570 (1986); United States v. Brown, 50 MJ 262, 267 (1999). I would remand this case to the Court of Criminal Appeals to be reconsidered in light of Ashcroft v. Free Speech Coalition, ___ U.S. ___, 122 S.Ct. 1389 (2002), and the particular record in this case.
