ORDERS GRANTING PETITION FOR REVIEW

No. 00-0494/AF. U.S. v. Edward S. TOWNS. CCA 33525. Review granted on the following issues:

I. WHETHER THE AIR FORCE COURT OF CRIMINAL APPEALS ABUSED ITS DISCRETION WHEN, AFTER FINDING THAT APPELLANT WAS SUBJECTED TO CRUEL AND UNUSUAL PUNISHMENT, IT FAILED TO GRANT APPROPRIATE RELIEF, EVEN THOUGH THERE WAS NO BASIS TO BELIEVE THAT THE CONVENING AUTHORITY CONSIDERED APPELLANT'S CRUEL AND UNUSUAL PUNISHMENT WHEN HE REDUCED THE ADJUDGED SENTENCE TO CONFINEMENT FROM 30 MONTHS TO 27 MONTHS.

II. WHETHER THE ADDENDUM TO THE STAFF JUDGE ADVOCATE'S ADVICE IS DEFECTIVE IN THAT IT FAILS TO ADDRESS THE SERIOUS ALLEGATIONS MADE BY APPELLANT IN HIS CLEMENCY SUBMISSION THAT HE WAS SUBJECTED TO CRUEL AND UNUSUAL PUNISHMENT IN VIOLATION OF HIS EIGHTH AMENDMENT AND ARTICLE 55, UCMJ, RIGHTS.

No. 00-0499/AR. U.S. v. Guillermo A. QUINTANILLA. CCA 9601468. Review granted on the following issues: I. WHETHER THE MILITARY JUDGE ERRED TO THE PREJUDICE OF APPELLANT WHEN HE ABANDONED HIS IMPARTIAL JUDICIAL ROLE AND THEREAFTER FAILED TO DISQUALIFY HIMSELF SUA SPONTE, PURSUANT TO RULE FOR COURTS-MARTIAL 902, SUBSECTIONS (a) AND (b).

II. WHETHER THE ARMY COURT OF CRIMINAL APPEALS ERRED TO THE SUBSTANTIAL PREJUDICE OF APPELLANT BY FINDING WAIVER AND NO PREJUDICE WHEN THE "INTEMPERATE" MILITARY JUDGE ABANDONED HIS IMPARTIAL JUDICIAL ROLE AND THEREAFTER FAILED TO DISQUALIFY HIMSELF SUA SPONTE, PURSUANT TO RULE FOR COURTS-MARTIAL 902, SUBSECTIONS (a) AND (b).

III. WHETHER THE EVIDENCE OF RECORD WAS LEGALLY INSUFFICIENT TO SUPPORT A FINDING OF GUILTY AS TO THE CHARGE OF FORCIBLE SODOMY (ADDITIONAL CHARGE I AND ITS SPECIFICATION).

IV. WHETHER THE MILITARY JUDGE'S ERRORS IN THE FINDINGS INSTRUCTIONS CAUSED PREJUDICIAL ERROR IN APPELLANT'S CASE.

V. WHETHER THE GOVERNMENT FAILED TO DISCLOSE MATERIAL EXCULPATORY EVIDENCE TO THE DEFENSE DURING APPELLANT'S COURT-MARTIAL, IN VIOLATION OF APPELLANT'S DUE PROCESS RIGHTS UNDER THE FIFTH AMENDMENT TO THE CONSTITUTION.

VI. WHETHER THE MILITARY JUDGE ERRED IN ADMITTING THE GOVERNMENT'S EXPERT WITNESS' TESTIMONY OVER THE DEFENSE COUNSEL'S DAUBERT OBJECTION.

No. 00-0555/AF. U.S. v. Timothy S. WHITNEY. CCA 32807. Review granted on the following issue: WHETHER THE MILITARY JUDGE COMMITTED ERROR WHEN, CONTRARY TO MILITARY RULE OF EVIDENCE 301(f)(3), HE ADMITTED TESTIMONY THAT, WHEN QUESTIONED BY AN INVESTIGATOR BEFORE TRIAL, APPELLANT ELECTED TO REMAIN SILENT AND SUBSEQUENTLY, AFTER DISCOVERING THE ERROR, MADE AN INADEQUATE AND UNTIMELY CURATIVE INSTRUCTION.

ORDERS GRANTING PETITION FOR REVIEW

No. 00-0279/MC. U.S. v. Anthony T. YOUNG. CCA 98-0505. Review granted on the following issue:

WHETHER THE LOWER COURT ERRED IN HOLDING THAT THE ADMISSION OF A TAPED CONVERSATION BETWEEN APPELLANT AND A COOPERATING WITNESS OCCURRING 23 DAYS AFTER THE CHARGED CONSPIRACY, INCLUDING WHAT COULD BE INTERPRETED AS THE PLANNING OF A FUTURE DRUG TRANSACTION, WAS PROPER TO SHOW APPELLANT'S INTENT WITH RESPECT TO THE PRIOR CHARGED CONSPIRACY, WHERE THAT PORTION OF THE CONVERSATION CONSTITUTED EVIDENCE OF UNCHARGED MISCONDUCT. No. 00-0431/AR. U.S. v. Stanley BARNER. CCA 9701385. Review granted on the following issues: I. WHETHER THE EVIDENCE IS LEGALLY SUFFICIENT TO SUPPORT A FINDING OF GUILTY OF SPECIFICATIONS 4 AND 5 OF ADDITIONAL CHARGE V (OBSTRUCTION OF JUSTICE).

II. WHETHER SPECIFICATIONS 4 AND 5 OF ADDITIONAL CHARGE V MUST BE CONSOLIDATED AS ONE SPECIFICATION BECAUSE APPELLANT'S ALLEGED ACTS CONSTITUTED ONE VIOLATION OF A SINGLE PROVISION OF MILITARY LAW PROHIBITING OBSTRUCTION OF JUSTICE; CONSOLIDATION IS CONSISTENT WITH THIS COURT'S OPINION IN UNITED STATES V. GUERRERO, 28 MJ 223 (CMA 1989).

THE AUTHENTICITY OF A VIDEOTAPE UNDER THE "SILENT WITNESS" THEORY WHERE THE CHAIN OF CUSTODY WAS INADEQUATE AND NO PHOTOGRAPHIC EXPERT TESTIFIED REGARDING THE INTEGRITY OF THE TAPE.

II. WHETHER THE MILITARY JUDGE ABUSED HIS DISCRETION WHEN, OVER DEFENSE OBJECTION, HE ADMITTED THE VIDEO CAMERA LOG SHEET UNDER THE "BUSINESS RECORDS" EXCEPTION TO THE HEARSAY RULE, WHERE THE EVIDENCE DID NOT ESTABLISH THAT THE LOG QUALIFIED AS A "RECORD OF REGULARLY CONDUCTED BUSINESS ACTIVITY."
