ORDERS GRANTING PETITION FOR REVIEW

No. 99-0545/AF. U.S. v. Shawn C. CLARK. CCA S29602. Review granted on the following issues specified by the Court:

I. WHETHER THE STIPULATION OF FACT (PROS. EX. 1) THAT WAS ADMITTED AS EVIDENCE DURING APPELLANT'S PROVIDENCE INQUIRY VIOLATED MIL.R.EVID. 707 AND UNITED STATES V. SHEFFER, 118 S.CT. 1261 (1998), BECAUSE IT STATED THAT APPELLANT AGREED TO TAKE A POLYGRAPH TEST AND THE TEST RESULTS REVEALED DECEPTION ON HIS PART.

II. WHETHER APPELLANT'S PRETRIAL AGREEMENT IS ILLEGAL OR VOID BECAUSE IT CONTAINED A STIPULATION TO USE POLYGRAPH EVIDENCE AT APPELLANT'S COURT-MARTIAL IN VIOLATION OF MIL.R.EVID. 707 AND UNITED STATES V. SHEFFER, 118 S.CT. 1261 (1998).

No. 99-0570/MC. U.S. v. Robert DIFFOOT. CCA 97-0515. Review granted on the following issue: WHETHER THE NAVY-MARINE CORPS COURT OF CRIMINAL APPEALS ERRED BY HOLDING THAT A "SERIES OF ERRORS" DURING THE TRIAL COUNSEL'S CLOSING ARGUMENT ON THE MERITS, INCLUDING REFERENCES TO APPELLANT'S RACE AND "GUILT BY ASSOCIATION," DID NOT AMOUNT TO PLAIN ERROR. No. 99-0571/NA. U.S. v. Todd A. TITTEL. CCA 97-1224. Review granted on the following issue: WHETHER THE NAVY-MARINE CORPS COURT OF CRIMINAL APPEALS ERRED BY AFFIRMING APPELLANT'S CONVICTION WHERE THE CONVENING AUTHORITY WAS AN ACCUSER AND THUS COULD NOT CONVENE APPELLANT'S COURT-MARTIAL.
PETITIONS FOR GRANT OF REVIEW - OTHER SUMMARY DISPOSITIONS

No. 98-0437/AR. U.S. v. David HIRALDO. CCA 9701543. On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, the decision of the United States Army Court of Criminal Appeals is set aside and the record is returned to the Judge Advocate General for remand to the Court of Criminal Appeals. That court will consider whether appellant is within the class of persons who are entitled to relief under United States v. Gorski, 47 MJ 370 (1997). If the court concludes that appellant is within such class, the court will refer the case to the Judge Advocate General for a determination as to the amount of relief that is warranted, if any.

Judge Effron did not participate in the Court’s prior action on this case. See 50 MJ 128. The case is now before the Court in a manner that does not require determination of the constitutionality under the Ex Post Facto Clause of the amendments to Title 10, United States Code, made by the National Defense Authorization Act for Fiscal Year 1996, Pub.L.No. 104-106, 110 Stat. 462-63 (1996). Accordingly, Judge Effron has participated in the present matter and will participate in any further proceedings on this case.

No. 99-0092/AR. U.S. v. Ricky M. JOHNSON. CCA 9601024. This is without prejudice to raising other issues in a petition after remand.

CRAWFORD, Judge (dissenting):

In the interests of judicial economy, this Court should determine whether there are any issues presented that warrant granting a petition before returning this case with a United States v. Gorski, 47 MJ 370 (1997), issue.

No. 98-1071/AR. U.S. v. Willie L. VERTISON. CCA 9600303.

On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals in each of the above three cases, it is ordered, that the decision of the United States Army Court of Criminal Appeals in each case is set aside; and that the record in each case is returned to the Judge Advocate General for remand to the Court of Criminal Appeals. That court will consider whether appellant in each case is within the class of persons who are entitled to relief under United States v. Gorski, 47 MJ 370 (1997). If the court concludes that any appellant is within such class, the court will refer such case to the Judge Advocate General for a determination as to the amount of relief that is warranted, if any.

Judge Effron did not participate in any of the above three case dispositions.
