No. 98-0971/AR. U.S. v. Moses LOVER, Jr. CCA 9500726. On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, we note that the members found appellant guilty of three of the five specifications under Charge III and of Charge III. The convening authority set aside the findings of guilty to those specifications and ordered them dismissed. However, he took no such action with respect to Charge III and thereby implicitly approved the finding of guilty to Charge III. Because "it is the specification which is the basis of guilt or innocence and criminality of an accused," United States v. Dilday, 47 CMR 172, 174 (ACMR 1973), and because this issue was first raised here, we believe that the court below should review it first. Accordingly, the petition for grant of review is denied as to Issues I, II, and III raised by appellate defense counsel; the decision of the United States Army Court of Criminal Appeals is set aside; the record of trial is returned to the Judge Advocate General of the Army for remand to that court for review of Issue IV raised by appellate defense counsel; and thereafter, Article 67, Uniform Code of Military Justice, 10 USC § 867, will apply.

    Judge CRAWFORD dissents.

APPEALS - SUMMARY DISPOSITIONS

No. 97-1061/CG. U.S. v. Frank J. DIRE. CCA 1077. On further consideration of the granted issue (49 MJ 131) in light of United States v. Gammons, 51 MJ 169 (1999), we conclude that "consideration of appellant’s nonjudicial punishment (NJP) record at sentencing was not error where the defense consented to its introduction and made the first substantive reference to the record during sentencing." Id. at 173. Moreover, appellant’s "failure to object constituted waiver under the applicable rules." Id. at 181 (citing RCM 1001(b)(2) and 1001(g), Manual for Courts-Martial, United States (1998 edition)). Accordingly, the decision of the United States Coast Guard Court of Criminal Appeals is affirmed.
