No. 96-1198/AF. U.S. v. Edward L. MITCHELL. CCA 31421. On further consideration of the granted issues in this case in light of United States v. Perron, 58 M.J. 78 (C.A.A.F. 2003), it is ordered that the decision of the United States Air Force Court of Criminal Appeals is reversed. The Court of Criminal Appeals made a finding of mutual misunderstanding of a material fact concerning a term of the pretrial agreement in this case. In light of this finding, that court’s imposition of alternative relief without Appellant’s assent violated Appellant’s right to due process. Therefore, the findings and sentence are set aside. A rehearing may be ordered.

On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, the Court grants the issue of witness interference personally raised by appellant pursuant to United States v. Grostefon, 12 M.J. 431 (C.M.A. 1982), but concludes that further appellate inquiry is necessary. See generallyUnited States v. Stombaugh, 40 M.J. 208, 212 (C.M.A. 1994); United States v. Campbell, 57 M.J. 134, 138 (C.A.A.F. 2002). Accordingly, it is ordered that the petition is granted as to the witness interference issue; that the decision of the United States Army Court of Criminal Appeals is set aside; and that the record of trial is returned to the Judge Advocate General of the Army for remand to the Court of Criminal Appeals for further appellate inquiry on the granted issue. The Court of Criminal Appeals is directed to obtain affidavits from relevant witnesses. If additional factual finding is necessary, that court shall order a hearing pursuant to United States v. DuBay, 17 C.M.A. 147 (1967). Once the necessary information is obtained, the court acting pursuant to Article 66(c), UCMJ, will reconsider appellant’s claim of witness interference. Thereafter, the record shall be returned to this Court for further review under Article 67, UCMJ. [See also ORDERS GRANTING PETITION FOR REVIEW THIS DATE.]
