Case Summary: GCM conviction for false official statement, wrongful use of a controlled substance, wrongful possession of a controlled substance, wrongful introduction of a controlled substance, larceny, assault upon a person in the execution of law enforcement duties, attempted indecent viewing, insubordinate conduct toward a non-commissioned officer, sexual assault, assault upon a commissioned officer, and assault upon a non-commissioned officer. Granted issue questions whether the offense of indecent viewing under Article 120c, UCMJ, includes viewing a visual image of the private area of another person.

Case Summary: Following the government's appeal of a military judge's ruling finding unlawful command influence and dismissing the charges, the NMCCCA reversed the trial judge's ruling. Appellant appealed and the Court granted review on the following issue: whether the military judge erred when he found the government failed to prove that unlawful command influence (1) would not affect the proceedings beyond a reasonable doubt, and (2) has not placed an intolerable strain on the public's perception of the military justice system.
