Brief of Amicus Curiae -- Protect Our Defenders

Case Summary: GCM conviction of attempted sexual assault of a child and attempted sexual abuse of a child. Granted issues question (1) whether Article 2, UCMJ, violates Appellant's right to equal protection where it subjects the conduct of all Fleet Reservists to constant UCMJ jurisdiction, but does not subject retired reservists to such jurisdiction; and (2) whether Fleet Reservists have a sufficient current connection to the military for Congress to subject them to constant UCMJ jurisdiction. The government has cross-certified the following issue: Whether Appellant waived or forfeited the right to assert that his court-martial violated his right to equal protection.

Granted issue questions whether the convening authority's failure to take action on the sentence as a result of the Staff Judge Advocate's erroneous advice deprived the Army Court of jurisdiction under Article 66, UCMJ.
