Case Summary: Appellant was charged with two specifications of sexual assault. The convening authority referred the charge and specifications to a general court-martial. Pursuant to a motion filed by the defense, the military judge dismissed the charge and specifications with prejudice for violating the Appellant's right to a speedy trial. The government appealed this ruling pursuant to Article 62, UCMJ. The Army Court granted the government's appeal and vacated the military judge's ruling. This Court granted Appellant's petition for review of the following issue: Whether the military judge abused his discretion by dismissing the charge and specifications with prejudice for a violation of R.C.M. 707.
