Case Summary: GCM prosecution for numerous violations of UCMJ Articles 81, 86, 89, 90, 120, 120a, 120c, 128 and 134. The military judge suppressed evidence obtained from Appellee's IPhone. The government filed an appeal under Article 62. The Army Court of Criminal Appeals denied the government's appeal. The Judge Advocate General of the Army certified the following issues: (1) whether the Fifth Amendment's self-incrimination clause is violated when a suspect voluntarily unlocks his phone without giving his personal identification number to investigators; (2) whether the Edwards Rule is violated when investigators ask a suspect, who has requested counsel and returned to his place of duty, to unlock his phone incident to a valid search authorization; (3) whether assuming investigators violated Appellant's Fifth Amendment privilege or the Edwards Rule, the military judge erred by suppressing the evidence.

NOTE: This case will be heard at Notre Dame Law School, Notre Dame, Indiana. Counsel for each side will be allotted 20 minutes to present oral argument.
