Case Summary: On 17 April 2025, the Judge Advocate General of the Army (Acting) filed a certificate for review of Appellee's case pursuant to Art. 67(a), UCMJ, asking the Court to address: (1) whether the Army Court erred in finding Appellant did not affirmatively waive multiplicity where counsel stated defense had no motions before entering unconditional guilty pleas and declined additional inquiry into matters relevant to the unit of prosecution; and (2) whether the Army Court erred in finding Appellant's convictions under Article 128b(1), UCMJ, facially duplicative when the underlying "violent offenses" were assault consummated by battery and aggravated assault.

NOTE: Hearing will be at the 82nd Hall of Heroes, 5108 Ardennes Road, Fort Bragg, North Carolina, as part of the Court's Project Outreach. Counsel for each side will be allotted 20 minutes to present oral argument.

Case Summary: GCM conviction for rape, sexual assault, abusive sexual contact, domestic violence and reckless operation of an aircraft. Granted issue is can the government properly refuse to disclose relevant, non-privileged data in its possession, custody, and control on the basis that the witness who provided the data gave limited consent with respect to its use? If not, is relief warranted?

NOTE: Hearing will be at the Wake Forest University School of Law, 1965 Wake Forest Road, Winston-Salem, North Carolina, 27016, as part of the Court's Project Outreach. Counsel for each side will be allotted 20 minutes to present oral argument.
