No. 10-07.  In the matter of Elyse Hope DILLER.  It appearing that the above-named attorney is a member of the Bar of this Court and that she was suspended from the practice of law in New York for three years, commencing July 24, 2003, and continuing until further order of the court with leave to apply for reinstatement by the Supreme Court of New York, Appellate Division, Second Judicial Department, that pursuant to Rule 15(b), Rules of Practice and Procedure, United States Court of Appeals for the Armed Forces, said attorney was suspended from the practice of law before this Court and was directed to show cause why she should not be disbarred, and considering her response to the show cause order and the serious nature of her misconduct, it is ordered that Elyse Hope Diller is hereby suspended indefinitely from the practice of law before this Court effective the date of this Order, with leave to apply for reinstatement should she be reinstated to the practice of law in New York.

SPECIAL DOCKET MATTERS

 

No. 08-02.  In the Matter of William Franklin PARTRIDGE, III.  The above-named attorney was suspended from the practice of law before the Court on December 6, 2007.  In the Matter of William Franklin Partridge, III, 65 M.J. 471 (C.A.A.F. 2007)(Order).  This suspension was a reciprocal action following his suspension by the Supreme Court of South Carolina and the United States Court of Appeals for the Fourth Circuit.  This Court’s order provided that Mr. Partridge’s suspension to practice law before the Court would continue “until such time as he is reinstated to the practice of law in the State of South Carolina and in the United States Court of Appeals for the Fourth Circuit, and upon proof of reinstatement, he petitions this Court for reinstatement to the Bar of the Court.”    Mr. Partridge has submitted a Petition for Reinstatement and provided proof of reinstatement by the Supreme Court of South Carolina and the United States Court of Appeals for the Fourth Circuit.  In view of his having satisfied the conditions for reinstatement to the Bar of this Court, it is ordered that the Petition for Reinstatement to Practice Law Before the Court from William Franklin Partridge, III, is hereby granted, and he is hereby reinstated to the Bar of this Court effective this date.

No. 10-0179.  U.S. v. Deanna T. THORNTON.  CCA S31692.  On further consideration of the granted issue (__M.J.__ (C.A.A.F. March 8, 2010)) in light of United States v. Roach, 69 M.J. 17 (C.A.A.F 2010) and Walker v. United States, 60 M.J. 354 (C.A.A.F. 2004), we hold (1) that after her recusal in the case, the Chief Judge of the United States Air Force Court of Criminal Appeals erred in taking further action by appointing a special panel to review the case, and (2) that this error was prejudicial because it tended to undermine the public’s confidence in the military justice process.  Accordingly, it is ordered that the decision of the United States Air Force Court of Criminal Appeals is vacated, and the case is remanded for a new review under Article 66(c), Uniform Code of Military Justice, 10 U.S.C. § 866(c) (2006), before a new panel.
