SARAVIA.  CCA 20060095.  Upon consideration of Appellant’s Motion to File the Petition for Grant of Review out of time, and the Government’s Motion to Dismiss Appellant’s Petition for Lack of Jurisdiction, we note that the United States Army Court of Criminal Appeals denied a timely motion for reconsideration on May 12, 2008, and that Appellant’s Petition for Grant of Review was filed on July 10, 2008.  Under Rule 19(g) of this Court’s Rules of Practice and Procedure, the Petition for Grant of Review was filed within sixty days following the decision of the Court of Criminal Appeals on the motion for reconsideration and is, therefore, timely.  Accordingly, it is ordered that the Appellant’s Motion to File the Petition for Grant of Review out of time is dismissed as moot, and that the Government’s Motion to Dismiss Appellant’s Petition for Lack of Jurisdiction is denied.
