No. 06-0801/AR.  U.S. v. Brannon C. JOHNSON.  CCA 20021156.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, and on consideration of the Government’s concession, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE ARMY COURT OF CRIMINAL APPEALS ERRED IN AFFIRMING APPELLANT’S CONVICTION FOR DISOBEYING A LAWFUL ORDER “TO NOT GO TO ST. SIMONS ISLAND” (ADDITIONAL CHARGE VI, SPECIFICATION 4) WHEN THE PROVIDENCE INQUIRY REVEALED THAT APPELLANT NEVER RECEIVED THAT ORDER.       

 
   The decision of the United States Army Court of Criminal Appeals is reversed as to Specification 4 of Additional Charge VI, but is affirmed in all other respects.  The finding of guilty as to Specification 4 of Additional Charge VI is set aside and that specification is dismissed.  

 

No. 07-0138/MC.  U.S. v. Pionell THOMAS.  CCA 200500939.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE NAVY-MARINE CORPS COURT OF CRIMINAL APPEALS ERRED BY FINDING THAT ECONOMIC HARM TO APPELLANT DUE TO POST-TRIAL DELAY IN HIS CASE WAS NOT “LEGAL PREJUDICE” BASED UPON THIS COURT’S DECISION IN UNITED STATES v. MORENO. 

 
   The decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside.  The record of trial is returned to the Judge Advocate General of the Navy for remand to the Court of Criminal Appeals for consideration in light of United States v. Jones, 61 M.J. 80 (C.A.A.F. 2005) and United States v. Ginn, 47 M.J. 236 (C.A.A.F. 1997).  Thereafter, Article 67, UCMJ, 10 U.S.C. § 867 (2000), will apply.

 

No. 07-0195/AF. U.S. v. Domingo A. RIVERA. CCA 63123.  On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, it is ordered that said petition is hereby granted on the following issue:

 

WHETHER THE APPROVED FORFEITURE OF PAY WAS IN VIOLATION OF RULE FOR COURTS-MARTIAL 1003(b)(2) WHERE IT WAS NOT STATED IN A WHOLE DOLLAR AMOUNT. 

 
   The decision of the United States Air Force Court of Criminal Appeals is affirmed as to findings and only so much of the sentence as provides for a bad-conduct discharge, forfeiture of $795.00 pay per month for one month, and reduction to pay grade E-1.

MORTON, Appellant.  CCA 002-07.  In this writ-appeal petition for review of the decision of the Coast Guard Court of Criminal Appeals on application for extraordinary relief, the Appellant seeks an order to permit the defense to prepare a “privileged verbatim transcript” of the pretrial investigation conducted under Article 32, Uniform Code of Military Justice, 10 U.S.C. § 832 (2000).  In the alternative, Appellant seeks an order prohibiting the Appellee from preventing the Appellant from preparing such a transcript of the proceeding.  On consideration thereof, the answer of the Appellee, and the reply of the Appellant, it is ordered that the writ-appeal petition is denied without prejudice to the Appellant to raise the matter in the course of future proceedings.  The stay issued on March 5, 2007, is vacated.*

(concurring in part, dissenting in part):  I would grant partial relief by ordering that Appellee take no steps to preclude an employee of the defense from attending the Article 32, Uniform Code of Military Justice, 10 U.S.C. § 832 (2000), hearing, as a member of the public and from transcribing the proceedings, subject to the investigating officer’s power to exercise reasonable control over members of the public attending the proceedings.  I would not address the issue of attorney work-product privilege at this time as that is a matter appropriately left to a military judge in the event of a trial by court-martial.

NIELAND.  CCA 2006-08.  On January 29, 2007, the United States Air Force Court of Criminal Appeals denied the Government’s appeal, filed under Article 62, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 862 (2000), of the rulings of the military judge suppressing the results of a government search and the admissions of Appellee to government agents.  The Government then filed a petition for grant of review under Article 67(b), UCMJ, 10 U.S.C. § 867(b) (2000), on February 2, 2007, seeking this Court’s review of the decision of the Court of Criminal Appeals.  On consideration thereof, it is ordered that said petition for grant of review filed by the Government be and the same is hereby dismissed for lack of jurisdiction.
