SCAMAHORN.  CCA 200201583.  On consideration of the petition for grant of review of the decision of the United States Navy-Marine Corps Court of Criminal Appeals, and in light of United States v. Moreno, 63 M.J. 129 (C.A.A.F. 2006), and United States v. Allison, 63 M.J. 365 (C.A.A.F. 2006), assuming that Appellant was denied his due process right to speedy post-trial review and appeal, we conclude that any error in that regard was harmless beyond a reasonable doubt.  Accordingly, said petition is granted on Issue I as raised by appellate defense counsel; and the decision of the United States Navy-Marine Corps Court of Criminal Appeals is affirmed. MISCELLANEOUS DOCKET – SUMMARY DISPOSITIONS

 

No. 07-8002/AF. Joshua P. LOVETT, Petitioner v. United States, Respondent.  On consideration of the petition for extraordinary relief in the nature of a writ of mandamus, filed pro se on October 2, 2006, to direct the Judge Advocate General of the Air Force “to provide the Petitioner appellate counsel for the review of his court-martial proceedings” under Article 67a, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 867a (2000), we note:  (1) on June 6, 2006, this Court affirmed the decision of the United States Air Force Court of Criminal Appeals (United States v. Lovett, 63 M.J. 211 (C.A.A.F. 2006)); (2) on July 10, 2006, Petitioner filed a pro se petition for reconsideration by mail; (3) on July 14, 2006, Petitioner’s appellate defense counsel informed him “that neither I nor any other attorney from the Appellate Defense Division will represent you in any further action you decide to take in your case”; and (4) on August 14,2006, this Court denied Petitioner’s request for reconsideration of the decision of June 6, 2006.  The Uniform Code of Military Justice provides:  “Appellate defense counsel shall represent the accused before the Court of Criminal Appeals, the Court of Appeals for the Armed Forces, or the Supreme Court . . . when requested by the accused . . . .”  Article 70(c)(1), UCMJ, 10 U.S.C. § 870(c)(1) (2000).  Petitioner’s case is not final as a matter of law.  See Article 71(c), UCMJ, 10 U.S.C. § 871(c) (2000).  The immediate question before us is not whether counsel must file any particular matter in the course of representing a servicemember, but whether counsel may discontinue such representation before the case is final as a matter of law.  Nothing in the record of the present case established a basis for counsel to sever the lawyer-client relationship. Accordingly, it is ordered that the Judge Advocate General of the Air Force shall provide appellate defense counsel to represent Petitioner for the purposes of review of his court-martial under Article 67a, UCMJ, 10 U.S.C. § 867a (2000).

Allison, 63 M.J. 365 (C.A.A.F. 2006), assuming that Appellant was denied his due process right to speedy post-trial review and appeal, we conclude that any error in that regard was harmless beyond a reasonable doubt.      Article 142 of the Uniform Code of Military Justice (UCMJ), 10 U.S.C. 942 (2000), authorizes the appointment of five judges to serve on the Court.  Two of the positions are vacant.  The three judges in active service will perform the functions of the Court.  See Articles 142(g) and 144, UCMJ, 10 U.S.C. 942(g) and 944 (2000), and U.S.C.A.A.F. Rule 6(a).
