No. 04-0799/NA. U.S. v. Timothy E. MILLER. CCA 200400762.  On consideration of Appellant’s petition for reconsideration of this Court’s decision in United States v. Miller, 63 M.J. 452 (C.A.A.F. 2006), our opinion concluded that counsel’s failure to communicate was harmless.  We note that our conclusion -- that any error was harmless -- implicitly determined that none of the issues now identified by Appellant established a basis for relief.   Accordingly, said petition for reconsideration is hereby denied.

 

No.05-0405/NA. U.S. v. Brian DEARING. CCA 200100291.  On consideration of Appellee’s petition for reconsideration of this Court’s opinion, 63 M.J. 478 (C.A.A.F. 2006), said petition for reconsideration is denied.

     A party seeking reconsideration bears the burden of demonstrating that the Court “overlooked or misapprehended” a point of law or fact.  C.A.A.F. R. 32.  The Government’s petition refers to our Court’s citation of United States v. Cardwell, 15 M.J. 124, 126 (C.M.A. 1983).  See United States v. Dearing, 63 M.J. 478, 484 (C.A.A.F. 2006).  Cardwell addresses the availability of self-defense when a routine altercation escalates into a lethal confrontation. 

     The Government contends that Cardwell is not a valid precedent in light of Rule for Courts-Martial (R.C.M.) 916(e)(4).  The Government’s position is inconsistent with the manner in which it has litigated this case. 

     In its brief to the United States Navy-Marine Corps Court of Criminal Appeals, the Government cited and discussed Cardwell  without any suggestion that Cardwell no longer served as a valid precedent.  There was no mention of R.C.M. 916(e)(4) in the Government’s brief.  The ensuing opinion of the Court of Criminal Appeals expressly stated that Appellant was “correct” in relying on Cardwell as an accurate statement of the law.  United States v. Dearing, 60 M.J. 892, 898 (N-M. Ct. Crim. App. 2005).  The Government did not appeal the decision of the Court of Criminal Appeals, nor did it challenge the opinion of that court in its brief to our Court.  The Government’s brief to our Court did not cite R.C.M. 916(e)(4), and it did not contend that Cardwell had been superseded or that it no longer constituted a viable precedent.  Instead of challenging Cardwell, the Government’s brief expressly noted that Cardwell had been called to the attention of the military judge, observed that the military judge had considered Cardwell, and contended that the present case could be distinguished from Cardwell.  In that context, we note that the general principles set forth in the rule are not necessarily in conflict with the specific guidance in Cardwell.  We also note that Cardwell has been cited by our Court subsequent to the adoption of R.C.M. 916(e)(4), see United States v. Martinez, 40 M.J. 426, 430-31 (C.M.A. 1994), and that it continues to be cited as a valid precedent in the literature.  See, e.g., Timothy Grammel, Annual Review of Developments in Instructions –- 2004, Army Law., Apr. 2005, at 35 n.113; The Judge Advocate General’s School Instructors, TJAGSA Practice Notes, Army Law., July 1989, at 40 (discussing assaults and mutual affrays).  Under the circumstances of this case, the Government has not demonstrated that the Court overlooked or misapprehended a point of fact or law that would warrant granting the Government’s petition for reconsideration.

No. 06-0571/AF. U.S. v. Christopher S. BARRETT. CCA 35790.  On further consideration of the granted issue (64 M.J. 87), and in light of the Government’s concession of error, the Court’s hearing notice of September 18, 2006, is vacated, and the decision of the United States Air Force Court of Criminal Appeals as to Specification 2 of the Charge and the sentence is reversed, but is affirmed in all other respects.  The finding of guilty of Specification 2 of the Charge and the sentence are set aside.  Specification 2 of the Charge is dismissed.  The record of trial is returned to the Judge Advocate General of the Air Force for remand to the Air Force Court of Criminal Appeals.  That court may reassess the sentence based on the affirmed guilty findings or order a rehearing on the sentence.
