POLFLIET Jr.  CCA 34652.  On further consideration of the issue granted review by this Court (59 M.J. 32 (C.A.A.F. 2003)), and the issues specified by this Court (62 M.J. 373 (C.A.A.F. 2005)), and in light of this Court’s decisions in United States v. Martinelli, 62 M.J. 52 (C.A.A.F. 2005), and United States v. Cendejas, 62 M.J. 334 (C.A.A.F. 2006), it is ordered that the following additional issue is specified for review by the Court:

 

WHETHER 18 U.S.C. § 2252A(a)(5)(A) APPLIES TO CONDUCT ENGAGED IN OUTSIDE THE TERRITORIAL LIMITS OF THE UNITED STATES WHEN CHARGED UNDER CLAUSE 3 OF ARTICLE 134, UCMJ.

 

and

 

     That Specification 2 of Charge V is amended to read as follows:

 

In that AIRMAN BASIC ROBERT J. POLFLIET, JR., United States Air Force, 374th Communications Squadron, did, at Yokota Air Base, Japan, on land and in a building owned by, leased to, used by or under the control of the United States Government, on divers occasions between on or about 24 August 1999 and on or about 16 June 2000, knowingly possess computer files containing images of child pornography in violation of Title 18, United States Code, Section 2252A(a)(5).

It is further ordered that the decision of the United States Air Force Court of Criminal Appeals is affirmed as to Charge V and its specifications as amended and in all other respects.

MILLER.  CCA 35703.  On consideration of the petition for grant of review of the decision of the United States Air Force Court of Criminal Appeals, we note that in Appellant’s supplement, the charged UCMJ article, summarized offense, pleas, and findings reference a not guilty plea to wrongful marijuana use instead of a guilty plea by exceptions and substitutions to desertion.  Accordingly, it is ordered that within 10 days of the date of this Order, counsel for Appellant will clarify the supplement to the petition; and that thereafter, appellate government counsel will have 10 days in which to file an answer.

GONZALEZ.  CCA 20020077.  On further consideration of the granted issue, 62 M.J. 391 (C.A.A.F. 2005), and in light of the Government’s concession, the decision of the United States Army Court of Criminal Appeals is reversed as to Specification 3 of Charge II and as to the sentence, but is affirmed in all other respects.  The finding of guilty as to Specification 3 of Charge II is set aside and that specification is dismissed.  The record of trial is returned to the Judge Advocate General of the Army for remand to the Court of Criminal Appeals.  That court may either reassess the sentence or order a rehearing.

 

No. 05-0642/AR.  U.S. v. Benjamin J. PARRISH, III.  CCA 20020178.  On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, said petition is hereby granted on the following issue:

 

WHETHER THIS COURT MAY APPROVE THE FINDINGS OF GUILTY TO SPECIFICATIONS 9 THROUGH 11 OF ADDITIONAL CHARGE I WHERE THE GOVERNMENT'S EVIDENCE DID NOT ESTABLISH A WRONGFUL WITHHOLDING UNDER ITS THEORY OF THE CASE, BUT PROVED A WRONGFUL OBTAINING WHICH OCCURRED OUTSIDE OF THE STATUTE OF LIMITATIONS.
