APPEALS – SUMMARY DISPOSITIONS

No. 00-5005/MC. U.S. v. Robert L. BARNES. CCA 94-1927. On consideration of the certified issue,* in light of United States v. Green, No. 00-0268, ___ MJ ___ (2001), we answer the certified issue in the affirmative. Accordingly, it is ordered and adjudged that the decision of the United States Navy-Marine Corps Court of Criminal Appeals is set aside. The record of trial is returned to the Judge Advocate General of the Navy for remand to that court for further consideration in light of Green.

GIERKE, Judge (concurring in part and dissenting in part):

I disagree with the majority’s decision to decide this case on the basis of the majority opinion in Green. SeeUnited States v. Green, No. 00-0268, ___ MJ ___, ___ (2001) (Gierke, J., dissenting). However, I believe that the facts in this case are sufficiently different from Green to warrant a different result.

It appears to me that the court below may have gone astray in this case when it evaluated the evidence outside the context of appellant’s positive urinalysis and concluded that the testimony of a neighbor whom appellant asked for drugs, standing alone, was insufficient as a matter of law to permit an inference of knowing use. See United States v. Perry, 37 MJ 363 (CMA 1993). Perry held that an "[a]ppellant’s knowledge of the identity of possible drug users neither proves nor disproves that, during the time period alleged, he knowingly used cocaine." Id. at 364. I agree with the Perry holding, but I see a significant difference between the probative value of knowing the identity of possible drug users, as in Perry, and the probative value of asking a neighbor for drugs, as in the present case.

I believe that the court below may have applied an incorrect legal standard to its legal sufficiency determination. In my view, the court below erred in concluding that there could be no permissive inference of knowing drug use without scientific evidence that appellant "experienced the physical and psychological effects of the drug." United States v. Campbell, 52 MJ 386, 388-89 (2000).

The absence of this scientific evidence is important when the prosecution relies solely on the positive urinalysis. However, in this case, the prosecution did not rely solely on the positive urinalysis, but also produced extrinsic evidence of knowing drug use.

I believe that appellant’s conversation with his neighbor must be viewed together with the positive urinalysis test, not independently of it. The question presented to the court below was whether any rational factfinder could have inferred that, based on the positive urinalysis test and the testimony of appellant’s neighbor, appellant knowingly used marijuana on the date charged. See Jackson v. Virginia, 443 U.S. 307, 319 (1979); see also United States v. Walker, 42 MJ 67, 71 (1995) (recognizing that prior drug use may be admissible under Mil. R. Evid. 404(b), Manual for Courts-Martial, United States (2000 ed.), to prove knowledge).

Under the circumstances, it is unclear to me whether the court below applied the correct legal standard in its evaluation of the legal sufficiency of the evidence. Accordingly, I join the majority’s decision to remand the case for reconsideration of the legal sufficiency of the evidence supporting the inference of knowledge.
