On consideration of the petition for grant of review of the decision of the United States Army Court of Criminal Appeals, we note that after this case was returned to the Judge Advocate General pursuant to this Court’s Order dated 14 December 2000 addressing the staff judge advocate’s characterization of a request for waiver of forfeitures, the new convening authority action (SCMO No. 26, dated 9 March 2001) erroneously approved the 4 months confinement that was adjudged rather than the 97 days approved in the original action (SCMO No. 5, dated 13 April 1999). The decision of the United States Army Court of Criminal Appeals dated 9 February 2000, which remains in effect, affirmed the original 97 days confinement. Accordingly, it is ordered that said petition is hereby granted; and that the decision of the United States Army Court of Criminal Appeals is affirmed.
