MISCELLANEOUS DOCKET - FILINGS

Misc. No. 00-8018/AR. United States, respondent, v. Wayne M. PARKER, petitioner. Petition for extraordinary relief in the nature of a writ of error coram nobis was filed under Rule 27(a) on July 17, 2000, and placed on the docket this date.

INTERLOCUTORY ORDERS

No. 00-0317/AR. U.S. v. O. J. Simpson LEE. CCA 9100691. Appellant filed a petition for grant of review directly with this Court in March 2000. On April 11, 2000, defense appellate counsel filed a motion for leave to file petition for grant of review out of time, noting that appellant was served with the decision of the court below dated July 3, 1991, on February 21, 1992. This motion contains the statement that "Counsel is unaware why appellant submitted his petition out of time." On April 12, 2000, government appellate counsel filed an opposition to the motion to file petition out of time, noting that all its files for this case had been purged because of the lengthy lapse of time.

On June 26, 2000, this Court issued an order directing counsel to explain "why they are unaware of any reason for the untimely submission by appellant."

On June 28, 2000, counsel filed an affidavit stating: "I am unaware why appellant filed his petition out of time as I have not been in contact with him."

Counsel must contact appellant, and pursuant to this Court’s June 26, 2000 order, furnish a reason for appellant’s untimely
filing. Appellant provided the Court, as a mailing address:

O.J. Simpson Lee
P.O. Box 1135
Moorhead, MS 38761-1135

If counsel is unsuccessful in locating appellant, counsel must show the Court what efforts were made in attempting to find him. Accordingly, it is ordered that defense appellate counsel advise the Court within 15 days of the date of this order of what efforts have been made to contact appellant or that appellant has been contacted and when he will provide the required information.
