MISCELLANEOUS DOCKET - SUMMARY DISPOSITIONS

Misc. Nos. 06-8019/MC & 06-8021/MC.  Jessie A. QUINTANILLA, Petitioner, v. United States, and Commandant, United States Disciplinary Barracks, Respondents.  CCA 9801632.  On consideration of the Petition for Extraordinary Relief in the Nature of a Writ of Mandamus, filed July 7, 2006, to direct the Commandant, U.S. Disciplinary Barracks, to remove Petitioner from death row, the Motion to Attach Document in connection therewith, the Petition for Extraordinary Relief in the Nature of Writs of Mandamus and of Prohibition, filed July 11, 2006, to direct the Judge Advocate General of the Navy to return the record of trial to the Navy-Marine Corps Appellate Review Activity and to prohibit further proceedings pending a decision of the Supreme Court of the United States, and the Motion to Stay Proceedings, the Court finds that Petitioner has unsuccessfully sought relief to that requested in the Petition for Extraordinary Relief filed on July 7, 2006, from the U.S. Navy-Marine Corps Court of Criminal Appeals.  Therefore, that pleading is more properly characterized as a writ appeal petition from the decision of that court.  Accordingly, it is ordered that the Petition for Extraordinary Relief under Rule 27(a) of the Rules of Practice and Procedure, to direct the Commandant, U.S. Disciplinary Barracks, to remove Petitioner from death row is re-characterized as a writ-appeal petition under Rule 27(b), and is docketed under that Rule vice Rule 27(a); that the Respondents file an answer to the writ-appeal petition under Rule 27(b) within ten days of the date of this Order; that Petitioner may file a reply within five days of the filing of Respondents’ answer; that the Motion to Attach document in connection with the writ-appeal petition is granted; that the Petition for Extraordinary Relief in the Nature of Writs of Mandamus and Prohibition, filed July 11, 2006, to direct the Judge Advocate General of the Navy to return the record of trial and to prohibit further proceedings is docketed and denied; and that the Motion to Stay Proceedings is hereby denied.  [See also MISCELLANEOUS DOCKET – FILINGS and INTERLOCUTORY ORDERS this date.]
